THE LAST WILL AND TESTAMENT OF JOHN ROSEBERRY

In the name of god amen: I, John Roseberry of Fayette Township Allegheny County Being weak in body but of sound mind Memory and judgement, Blessed be almighty god for the same, but considering the uncertainty of this transitory life do make ordain and publish this my last will and testament in manner and form following, Viz., first of all I commit my immortal soul into the hands of God who gave it and my body to the earth to be buried in
a Christian and decent like manner, and after the payment of all my just debts and funeral expenses I dispose of my worldly property as follows - -
first I bequeath to my beloved wife Sarah all my household property to use and dispose of at her own pleasure, also eight hundred Dollars with the yearly incomes of the whole of my real estate with the exception of the Mill property for her use during her natural Life also whatever sheep I possess with two cows and one horse, if my wife should marry her husband shall have no controle over the property which I have willed to her for maintenance. 2. I bequeath to my Brothers William Robert Alexander James and Isaac Roseberry and my sister now Jane Henderson the residue of my whole estate in equal parts after the payment of their bequeathments herein made, 3. I bequeath to John Robb son of my niece daughter of my Brother Robert Roseberry one hundred Dollars, 4th I bequeath to John Brown son of James Brown one hundred dollars, 5th I bequeath to Alexander Fitzpatrick the piece of Land I purchased of Hugh Langan with the addition of twenty or thirty acres more described as follows, beginning at the publick orchard at the lower end of the field below the house thence with the said fence into the hollow thence by the fence up to the allum trees thence along the orchard fence to the line betwixt Langan's house and myself together with about two acres above Fitzpatricks house the line going up the hollow from the house about ten or twelve rods thence along above a Shugar tree two rods thence past the said Shugar tree about two rods then down the hill to the Line between Langan's house and myself, also one half of that Land I purchased of Biggart. I also bequeath to said Fitzpatrick's son John Roseberry Fitzpatrick Three hundred Dollars, I also bequeath to said Fitzpatricks the daughters Alinor Sarahjane and Isabella two hundred Dollars each, the above bequeathments to Alexander Fitzpatrick is made in consequences of his services to me in my life time, I also bequeath to Rudolph Clark the remainder of my old place also one half of
that Lot of Land I purchased of Biggart subject to the payment of eight hundred Dollars to the said Fitzpatricks children when they come to age of twenty one and if the said Rudolph is not prepared at that time it is my will he shall have two years indulgence on each of the bequeathments tom said Fitzpatricks children, this eight hundred Dollars is part of the
before mentioned bequeathments to said children, if any of the said children should be removed by Death before receiving the amount bequeathed to them said Rudolph is exempted from payment of said bequeathment but should the said Rudolph not behave himself in a becoming manner to my beloved wife Sarah he forfits his claim to said estate, also I bequeath to John Roseberry son of my Brother Isaac Roseberry one hundred Dollars, also I bequeath to John Roseberry son of my Brother William Roseberry one hundred Dollars and if any of my said Brothers or their families cannot be found in three years after my decease and the decease of my wife then in that case my remaining Brothers and sister or their familys, in case of their Decease shall inherit the said Brothers shares in equal part, I also bequeath to the trustees of Robinson Run Congregation one hundred Dollars for the benefit of said congregation, my will is that my executors provide tombstones for my own and my wife's graves with appropriate inscriptions.
Lastly I hereby nominate and appoint Archibald Cook and William Dickson as the sole Executors of this my last will and testament hereby revoking all other wills and legacys and Bequeathments by me heretofore made declaring this and no other to be my last will and testament in testimony I have hereunto set my hand and seal this Thirteenth Day of March in the year of our Lord one thousand eight hundred and forty one.
